The owners of a 13-acre property have a mediation set for Wednesday with the City of Titusville to try and find an alternate outcome for a zoning request denial to build two homes on the property near Columbia Blvd and Windover Way

The owners of the 13-acre property submitted a Request for Relief pursuant to Section 70.51 Florida Statutes and Request for Informal Mediation pursuant to Section 163.3181(4) Florida Statutes.

Per these state laws, “If a local government denies an owner’s request for an amendment to the comprehensive plan which is applicable to the property of the owner, the local government must afford an opportunity to the owner for informal mediation or other alternative dispute resolution.

The costs of the mediation or other alternative dispute resolution shall be borne equally by the local government and the owner. If the owner requests mediation, the time for bringing a judicial action is tolled until the completion of the mediation or 120 days, whichever is earlier.
