A Brevard County disabled veteran has filed a lawsuit against the City of Titusville and its City Manager, Scott Larese, alleging wrongful termination and violations of the Americans with Disabilities Act (ADA).
The plaintiff, a disabled U.S. military veteran, claims the city failed to accommodate their disabilities and forced them to resign after assigning physically demanding tasks unrelated to their job description.
According to the complaint filed in the Eighteenth Judicial Circuit Court, the individual was hired as a Logistics Coordinator in May 2023 after negotiating a $22-per-hour wage, having initially declined the position due to lower pay.
The lawsuit states that the plaintiff disclosed their disabilities—including a Traumatic Brain Injury (TBI) and chronic migraines—during the hiring process and was assured by supervisors that accommodations, such as a helper, would be provided.
However, the complaint alleges the plaintiff was repeatedly assigned strenuous physical labor, such as cleaning bathrooms, operating power tools, and performing yard work, tasks not included in the Logistics Coordinator role.
The filing details multiple instances where the plaintiff raised concerns about their ability to perform these duties, including a June 2023 meeting where HR leadership reportedly acknowledged the city had “failed” to support them. After being informed no alternative positions were available, the plaintiff claims they were effectively forced to resign on June 19, 2023.
The lawsuit accuses the city of denying reasonable accommodations, failing to engage in an interactive ADA process, and causing significant financial and emotional harm.
The Equal Employment Opportunity Commission (EEOC) issued a right-to-sue notice on October 22, 2024. The plaintiff seeks damages for lost wages, mental anguish, attorney’s fees, and other relief.
The plaintiff’s attorney emphasized in the complaint that their client accepted the role based on the original job description and only requested accommodations when assigned unrelated tasks. “The City of Titusville disregarded its obligations under the ADA, leading to severe consequences,” the attorney stated.
